just quick update asked me post update when had report.
after having written letter o2 stating case (that believed under sale of goods act entitled repair or replacement iphone 3g) called me "weren't willing 'overturn apple's decision' not repair or replace phone free of charge".
pointed out them wasn't apple's decision make since phone out of warranty , @ point bloke's argument crumbled. quite amazed how uninformed on consumer legislation possible if working in department must deal daily cases such mine.
so, 2 minutes of stating case , firmly (and advising if didn't outcome expecting next step me begin county court claim) resulted in o2 rep agreeing send me out new handset arriving on tuesday. i've received stamped, addressed jiffy bag sending old handset i'll wait until tuesday before sending off.
